- Title
TORT CLAIMS AGAINST STATE GOVERNMENTS.
- Authors
SHUMATE, ROGER V.
- Abstract
The article offers information on the state's liability in cases of torts in the U.S. Tort claims against the state can be either those growing out of tort, or those growing out of contract. As the state now engages in various regulatory and service activities, it has come into more frequent conflict with its citizens than ever before. The state's responsibility to private individuals for damages has been reconsidered since the state has been more reluctant to accept liability in cases growing out of tort than that of contract. The U.S. Court of Claims has been established by the Congress with jurisdiction over cases growing out of contracts.
