- Title
THE MYTH OF THE VOID DIVORCE.
- Authors
HARPER, FLOWER V.
- Abstract
The article discusses the term void divorce. A void judgment is the one which has been given by a court but lacks jurisdiction and thus has no legal effect. A valid judgment, on the contrary, is the one given by a court under conditions which are compliant with the rules of jurisdiction. In case of divorce, a decree of divorce rendered by a court of the U.S. state of Nevada must be recognized as valid by the other 47 U.S. states. Two aspects to the jurisdictional problem have been known, jurisdiction over the person and jurisdiction over the subject matter of the action.
