- Abstract
The article presents an application of American legal scholar John Hart Ely's theory of constitutional interpretation, which focuses on judges' role in the failure of the democratic process, to the U.S. Supreme Court constitutional law case Citizens United v. Federal Election Commission. It analyzes Ely's book "Democracy and Distrust," and reflects that constitutional interpretation trusting judges and legislators to regulate the political process should be reformulated.
