- Abstract
The article discusses the court case Hardt v. Reliance Standard Life Insurance Co., in which the U.S. Supreme Court considered whether Section 1132(g)(I) of the Employee Retirement Income Security Act of 1974 (ERISA) limits the availability of attorney's fees to prevailing parties. It notes that the Supreme Court correctly followed its precedent concerning statutory deviations for the American Rule of attorney's fees. It discusses the facts of the case involving Bridget Hardt, an employees of Dan River Inc., and Reliance Standard Life Insurance Co.
