- Abstract
The Bundeskartellamt’s proceedings against Google’s data practices elucidate the interpretation of Sec. 19a of the German Competition Act, the relationship between Sec. 19a and the Digital Markets Act (DMA) and the interpretation of the DMA itself. The Bundeskartellamt considered Google’s data practices to be a potential violation of Sec. 19a (2) No. 4. The commitments extend the scope of the obligations of Art. 5(2) DMA to services that have not been designated as a core platform service. The Google data case clarifies the limits of parallel enforcement under Sec. 19a alongside the DMA as well as possible opportunities for such an approach. The DMA calls for a close coordination between NCAs and the Commission to ensure consistent decision making.
