- Abstract
Narrow parity clauses seem to be exempt under the new Vertical BER. The European Commission apparently considers narrow parity clauses typically to fulfill the exemption requirements under Art. 101(3) TFEU, at least below the marketshare threshold. This contrasts with the decision of the German Federal Supreme Court (BGH) in Booking.com, in which the BGH decided that narrow best price clauses have “manifest restrictive effects on competition“ and do not – at least not typically – fulfil the exemption requirements under Art. 101(3) TFEU. This article concludes that the block exemption of narrow parity clauses is incompatible with Art. 101(3) AEUV and therefore null and void. Undertakings using narrow parity clauses do not benefit from the safe harbor.
