- Title
A CRITIQUE OF THE DOCTRINE OF FORUM NON CONVENIENS.
- Authors
Petsche, Markus
- Abstract
The article focuses on the criticism rendered to the doctrine of forum non conveniens by law professionals in common law countries such as the U.S., Canada, and Australia. As per the doctrine, a court may refuse to hear a case if it constitutes an inadequate forum. It informs that the doctrine directs to inconsistent results and courts hardly rely on them to pursue objectives such as in case of protection of domestic corporations. It also evaluates the legitimacy of the doctrine theory.
