- Title
Abdelrazik: Tort Liability for Exercise of Prerogative Powers?
- Authors
Chamberlain, Erika
- Abstract
The article discusses the case of the Canadian citizen Abousfian Abdelrazik who was arrested and detained by Sudanese authorities, during which time his passport expired. It states that his efforts to return to Canada were hampered by suspicion that he was a terrorist, however, Abdelrazik was finally able to obtain an airline ticket to Toronto. When he contacted the Minister of Foreign Affairs to obtain his emergency passport, it was refused. It notes that the statement of claim filed by Abdelrazik in the Federal Court against the Attorney General and the Minister of Foreign Affairs will be the most high-profile instance of misfeasance in a public office being claimed for the exercise of a prerogative power.
