The article focuses on the impact of Section 794(2) of the Canadian Criminal Code on the Canadian criminal justice system. Topics discussed include role of section 794(2) in placing burden of proof on the accused by forcing summary conviction trials; background and historical evolution of the section; and R v H (P) court case in which deals with constitutional interpretation of section 794(2). It also examines the constitutionality of the section under Canadian Charter of Rights and Freedoms.
