- Abstract
The article looks into the disparity in the Sixth Amendment right of confrontation given to criminal defendants at trial and the one granted by the Federal Death Penalty Act of 1994 (FDPA) during death-eligibility determinations in the U.S. The authors point out that the Confrontation Clause of the Sixth Amendment grants the accused the right to be confronted. They mention that 18 U.S.C. § 3593(c) prevents capital defendants of the Sixth Amendment right of confrontation.
