- Abstract
In the article "No admission of a mediator as an in-house lawyer", it is stated that a mediator working at a consumer dispute resolution body cannot be admitted as an in-house lawyer. The Federal Court of Justice (BGH) argues that the legal requirements for admission are not met, as the mediation activity focuses on the rights and obligations of the parties to the dispute, rather than those of the mediation body. The Federal Bar Association (BRAK) supports the adaptation of out-of-court dispute resolution to digital markets and emphasizes the importance of clear quality criteria and independent examinations. The BRAK also advocates for clear rules regarding the right to defense, representation of the parties, and procedural costs.
