- Abstract
The objective of this article is to analyze the extent to which international standards regarding the protection of the right to health of the migrant population have been received and implemented by the Colombian State in response to the significant influx of Venezuelan migrants resulting from the ongoing crisis. For such purposes, we will review the normative provisions issued by the Colombian government. In addition, we will examine some of the judicial rulings through which the Constitutional Court has guaranteed the right to health to the migrant population. We will also analyze the existing international standards for the protection of the right to health, considering if these have been taken into consideration, both in the legal norms pertaining the increase in the presence of Venezuelan people in Colombian territory and in the Constitutional Court's rulings. We will analyze these instruments within the timeframe of 2015 to the present, which encompasses the time of the return of many Colombian citizens from Venezuela due to the State crisis that broke out in the neighboring country, which generated an increase in migration. This analysis of standards, judicial decisions (national and international) and regulatory provisions will enable us assess the extent to which the Colombian State has fulfilled its obligation to safeguard the human rights of the migrant population, specifically in terms of the right to health.
