- Abstract
The article discusses the court case Jones v. Aetna Life Insurance Co., et al. wherein the Eighth Circuit Court of Appeals resolves a conflict regarding whether an individual may file claims concurrently under 29 USC §1132(a)(1)(B) and §1132(a)(3) to recover benefits provided under a health insurance plan. The court held that Boeing employee Jones could proceed with her breach-of-fiduciary-duty claim against Aetna for denying her short-term and long-term disability benefits.
