- Abstract
The article discusses a court case wherein the employees have entitlements to health plan benefits along with other pension benefits. It cites the case filed against Simpson Paper Co. by the early retirees among its mill workers who were represented by a union in collective bargaining agreements. The Employee Retirement Income Security Act (ERISA) rules that beneficiary may recover benefits under an enquitable estoppel theory even if the rights to the benefits are not fixed or unalterable.
