- Abstract
The article examines the implications of the use of the U.S. Federal Trade Commission (FTC) of Section 5 of the FTC Act in the settlement of Intel Corp. for alleged engagement of the company in a course of conduct that violated the said section. It explores the conduct of Intel through the lens of the objections levied against it by the FTC. It also presents an analysis of the rule and proposes a legal standard that can confine Section 5 enforcement.
