- Abstract
The Higher Regional Court of Frankfurt has ruled that platform operators can be held liable for violations of competition by the providers. In the specific case, it concerned the labeling of plant-based milk substitutes as "milk" on the Amazon-Marketplace sales platform. The court determined that the operator is obligated to prevent similar violations, even beyond the specific offer. Furthermore, it was decided that the labeling of a product as "Amazon's choice for rice milk" does not mean that the provider themselves uses the term. The decision is based on various legal foundations, including the German Act Against Unfair Competition (UWG) and EU Regulation No. 1308/2013.
