- Abstract
Femtech refers to electronic devices, software, or other technology relating to women's health. Employers are contributing to the rapid growth of femtech by adopting femtech products for workplace wellness programs. Due to a lack of federal laws or regulations, employers can access the personal, intimate information their employees record in these femtech products which can subject employees to pregnancy discrimination. Congress must enact a comprehensive consumer rights law and give the Federal Trade Commission more plenary power to prevent femtech companies from selling consumers' private health information to employers. Key points for the family court community: The femtech industry is expected to become a $50 billion dollar industry by 2025.In 2021, the United States had the highest number of femtech companies in the world at 51% while the United Kingdom is second at 10%.In the past 5 years, digital apps used for pregnancy, post‐partum, and parenthood accounted for 37% of women's health companies founded.1 in 5 mothers report they have experienced pregnancy discrimination in their respective workplace in the United States.About 5300 pregnancy discrimination charges are filed each year, which only compose of about 2% of total pregnancy discrimination incidents filed with the federal Equal Employment Opportunity Commission or state Fair Employment Practices Agencies.
