- Title
PRESENTE Y FUTURO DE LA JUSTICIA ADMINISTRATIVA EN LA IGLESIA.
- Authors
CANOSA, JAVIER
- Abstract
The deepening into the rights of the faithful carried out from the II Vatican Council henceforth was translated, among other things, in the development of the Administrative Justice in the Church, which had as its first phase the institution, in June of 1967, of the second section of the Apostolic Signature, as a contentious administrative tribunal. It is reflected later on in the regulation of the acts and administrative recourses contained in the CIC (1983) and in the CCEO (1990). After twenty-five years from the promulgation of the CIC, the actual phase of the evolution of the canonical Administrative Justice is seen stimulated by the recent promulgation (2008) of the Law proper to the Apostolic Signature. There is a reason to hope that the jurisprudence may begin to be published systematically; with which, if it is realized in an adequate manner, it will be converted into a useful instrument for the government function in the Church, aside from contributing to the betterment of Administrative Justice.
