- Abstract
The article reflects on the mistakes made by England and Wales in adopting the methods while reforming the Charities Act 2006 (UK) c 50. It cites the reference of the court case The Commissioners for Special Purposes of the Income Tax v Pemsel. It further explores the ways of understanding the foundational elements of charity jurisprudence and suggests that the nation has followed wrong direction of reforms in the way of making progress.
