- Abstract
The article discusses the criteria given by IMF Australia Ltd. (IMF) to fund class actions in Australia. Accordingly, IMF is the largest litigation funder in the country who financed many significant Australian representative proceedings and class actions provided that claimants agree to reimburse the funder's direct outlays on the settlement or damages awards. In this regard, IMF sets the criteria to fund class actions including the requirement to meet the threshold of section 33C of the Federal Court of Australia Act 1976.
