- Abstract
The article argues that the Supreme Court's decision in case "Garcetti v. Ceballos" substantially changed the judicial inquiry into public-employee speech by creating a new threshold question. Topics discussed include criticism of Garcetti and the confusion it has produced among the circuit courts; theoretical explanations of the differences between questions of law' and additional procedural issues raised by the mixed-question classification.
