- Abstract
The article focuses on the settlement of the ambiguities inherent in the implementation of the Street Terrorism Enforcement and Prevention Act (STEP Act) by appellate courts and proposed a new interpretation of the enhancement statute in California. It states that the gang enhancement statute has produced disparate and conflicting array of interpretations among intermediate appellate courts in the state despite the huge legislative effort spent on its drafting. It recommends that a single, unifying definition encompassing only those crimes committed because of the defendant's relationship to the gang can replace the disparate and conflicting attempts by appellate courts to define gang-related crimes subject to additional punishment under STEP Act.
