The article focuses on historical context and legal background of Chapter 838 of the California Homeowners Bill of Rights (HBOR) which provides better enforcement against wrongful and preventable foreclosures. Topics include federal regulation relating to mortgage servicing; creation of the Consumer Financial Protection Bureau through statute of Dodd-Frank Wall Street Reform and Consumer Protection Act; and the National Mortgage Settlement.
