- Abstract
In this paper the author looks at horizontal contracts and contractual practices which are the most common forms of restricting competition in the European Union market. . These agreements and practices apply to companies positioned at the same market level. Specifically, the author analyzes contracts that set prices or other trading conditions, contracts that limit or control production, market, technical development or investment, market sharing agreements, contracts that apply different conditions to the same or similar legal matters with other trading partners. Special emphasis is placed on oligopoly agreements and trade practices, as a particularly sophisticated way of distorting or preventing free competition in the union. In conclusion, the emphasis is on the institutional approach of the European Commission and the European Court of Justice and their methods in combating the restriction of competition and on the optimal functioning of the European Union's internal market.
