- Abstract
The subject of this research is establishing the difference between the two concepts of divorce, the contemporary divorce regulated in the Macedonian family law and divorce in Roman law. The main goal of this research is to penetrate in divorce institution in historical context and in contemporary conditions according to the Family Law (Official Gazette of the Republic of Macedonia, No. 153 from 20.10.2014) and thereby to perform a research about divorce and the reasons for divorce. Primary and secondary sources are used within the historical method, especially the comparing technique. In addition we need to study the impact of divortium on the contemporary divorce, which is in fact the main hypothesis of this research, as well as an indication on the secondary hypotheses of the research consisted in the research, which one of the spouses filed a complaint for divorce, which are the reasons for divorce, to finally conclude that divorce is very common in modern conditions, which is associated with individual human rights and freedoms, and the individual freedom. A decision of the individual whether to live in a marriage or not, whether to initiate proceedings for divorce or remain living in marriage even thaw it doesn't work for various reasons. It is a fact that successful marriages don't get divorced.
