- Abstract
This article discusses on the appeal from the confirmation of an arbitrator's award under the Supreme Court of Oregon. The Supreme Court of Oregon, in this appeal from the confirmation of an arbitrator's award, affirmed the lower court's judgment and held that the scope of judicial review of an award is defined in ORS 33.320. Arbitrators are vested with the power to decide both the law and the facts involved in the case submitted to them. The arbitrator had been selected by agreement of the parties. The problem submitted to the arbitrator involved the allocation of responsibility of payments required by certain labor awards and the time such allocation had to be made. The court rejected the argument of appellant that the arbitrator had exceeded his powers because the arbitrator had selected allocation by application of the provisions of a former contract contrary to appellant's contentions.
