PENNSYLVANIA BOARD OF ARBITRATION OF CLAIMS -- SCOPE OF REVIEW P.L. 728 AS AMENDED, 72 P.S. §4651-8 (c) -- INTEREST ON AWARD AGAINST THE COMMONWEALTH.
- Abstract
This article reports that the Commonwealth Court of Pennsylvania has held that where the award of the Board of Arbitration of Claims is in accordance with law and has substantial evidence to support its findings the award must be confirmed even though the Board admitted parole evidence to complete the terms of a written lease. However, the award was remanded for the computation of interest payable at six percent per annum. The court reasoned that sovereign consent to suit was given by the legislature's creation of the Board of Arbitration of Claims to resolve contractual disputes involving the Commonwealth.
