- Abstract
This article focuses on recent case law analyzing and applying the U.S. Supreme Court's decision in Daubert v. Merrell Dow Pharmaceuticals Inc., and the ways in which expert testimony is challenged. It examines one of the major ways in which unreliable expert testimony is revealed through the discovery process. It also explains how some aspects of the the 2010 amendment of Rule 26 of the Federal Rules of Civil Procedure has made challenging expert testimony difficult.
