- Abstract
The article discusses the court case wherein defendant Javier Garcia-Cepero was convicted with operating a motor vehicle under the influence of alcohol. It mentions that Garcia-Cepero claimed his equal protection and due process rights were violate because of how the New York City Police Department had administered a breathalyzer test to a non-English speaking person. It states that the Bronx County Supreme Court had held the procedure as violation to the rights of Garcia-Cepero.
