- Abstract
The article discusses the significance of victim opinion statement to hear the concerns and views of victims on the crime they have involved into. It elaborates that victims must be given rights to speak their opinions out on the length and type of conviction that should be imposed on a defendant in a capital case. It examines the lack of Supreme Court's lack of clarity on the admission of victim opinion statements on its decision to the Booth v. Maryland and Payne v. Tennessee court cases. It also investigates how the Eight Amendment of the U.S. Constitution establishes a per se bar against the sentencing recommendation of victim in a capital case.
