- Abstract
Everyone has the right to demand that their personal rights be protected against unlawful attacks everywhere and against everyone. Personal rights are protected by the Constitution, international conventions and laws. In the employment relation that the workers establish with the employer, the employer has the right to give orders and instructions, the power to set rules, and is economically and socially stronger than the worker. Labor law is a branch of law that has emerged to protect the employer's authority by ensuring the rights of the worker. The most important limit of the right to give orders and instructions used by the employer in the employment relation is the personal rights of the employee. No employer's instructions can be of such a size as to abolish the employee's personal rights. On the other hand, a worker is a person who has to work in a physical place with more than one person. In this place, it is under the need to protect personal rights against attacks from other workers. In practice, all behaviors that violate the employee's personal rights in the workplace, especially in the workers and the press, are generally both perceived and expressed as mobbing. In this study, the attacks on the employee's personal rights in the workplace in the axis of judicial decisions, the legal protection of the worker against these attacks and the concept of mobbing will be discussed. Especially with mobbing, it will be tried to show that every attack against the employee's personal rights and every ill-treatment is not mobbing.
