- Abstract
The article presents U.S. legal cases and developments in marketing relative to the regulation of unfair competition. In reference to advertising the Philip Q. Zauderer v. Office of Disciplinary Counsel of the Supreme Court of Ohio and the Amrep Corp. v. FTC cases are cited. The U.S. Supreme Court held in the former case that illustrations in advertising by attorneys are protected by the commercial speech provisions in the U.S. Constitution's First Amendment. In reference to nonadvertising promotional methods the American Financial Services Association v. FTC case is cited. In 1985 the U.S. Federal Trade Commission (FTC) issued a Credit Practices Trade Regulation Rule containing provisions related to certain creditor remedies.
