The article discusses the notion of true threats in relation to free speech rights under the First Amendment to the U.S. Constitution. Topics include the U.S. Supreme Court case Elonis v. United States in relation to the categorical approach to free speech rights, the interpretation of the U.S. Supreme Court case Chaplinsky v. New Hampshire, and the role of courts in the possible suppression of free speech.
