- Abstract
This article analyzes the legal differences between the Massachusetts (MA) and California (CA) legislation about same-sex marriage. The MA court used the "rational basis" review and the CA court used the "strict scrutiny" review. CA Chief Justice Ronald M. George discovered that discrimination against gays on the basis of their sexual orientation alone was equivalent to discrimination against racial minorities. According to public opinion, the CA Supreme Court is the most respected state high court in the U.S.
