- Abstract
In this article, the author examines the property rights of judges and the violation of the due process clause by the judges. He discusses the case from the U.S. Supreme Court of Stop the Beach Renourishment, Inc. v. Florida Department of Environmental Protection for the purpose of judicial takings and the violation of the constitution. He focuses on perception of framers and philosophers on property rights and the evolution of prepolitical nature of property from customary law.
