- Abstract
The access to justice is subject to the delivery of a solution in the criminal prosecution stage, whether it is about bringing to justice or not. Thus, a solution of not bringing to justice allowed the petitioner the access to justice in terms of art. 278¹ of the Code of Criminal Procedure, and a solution of bringing to justice necessarily required the court to rule on maintaining or removing the protective measure. Moreover, art. 168 para. (3) of the Code of Criminal Procedure enables after the final resolution of the criminal proceedings, if no claim was filed against the way of fulfilling a protective measure, a challenge may be filed according to the civil law" which means another way to access to justice.
