- Abstract
This article discusses the enforcement of class action waivers against employees who bring pattern-or-practice and disparate impact claims under Title VII of the Civil Rights Act of 1964, with respect to the Epic Systems Corp. v. Lewis decision. It discusses the Federal Arbitration Act, the National Labor Relations, and the majority opinions of the Epic Systems decision. It evaluates Justice Ginsburg's argument regarding class action disparate impact claim in individual arbitration.
