- Abstract
In this article the author discusses the role of the Communications Decency Act (CDA) in preventing the right of publicity exploitations in the U.S. The author explores the legislative history and policy of the CDA which was originally created to regulate indecency and obscenity on the Internet. The author cites that the right of publicity is an intellectual property right which must be exempted from the immunity of tort liability granted by the CDA to interactive computer service users.
