The article offers information on the controversies related dual purpose documents presented in the work product doctrine, codified in the Federal Rules of Civil Procedure Rule 26(b)(3) in the U.S. It offers information on dual purpose served by the document which includes business purpose related to company and litigation purpose related to lawsuits. It presents information on several approaches presented by federal courts that determines the constituents of document.
