- Abstract
The article discusses eminent domain in India in the early 21st century. The author argues that eminent domain is an essential government power used to maximize land use efficiency but must remain limited in order not to hinder economic development. The article examines the 1894 legislation the Land Acquisition Act (LAA) written during British rule and Indian land reforms in the 20th century, the history of eminent domain practices and land reform in the U.S., and land reform laws in India after independence. It also discusses the U.S. Supreme Court case Kelo v. City of New London.
