The article tackles the conceptual ambiguity regarding the interpretation of the Export Clause of the U.S. Constitution. Topics discussed include constitutionality of an excise charge on oil exports used to remediate environmental damage from oil spills in the case Trafigura Trading LLC v. United States, history of the Export Clause and precedent cases, user fees in the Export Clause context, and economic and common law approaches to evaluate whether a charge passes the use test.
