- Abstract
The article reports on the Lenz v. Yellow Transportation, Inc. 431 F.3d 348 case and the 8th Circuit appeals court ruling in December 2005 which helps define which employees are covered under the Federal Arbitration Act. The FAA exemption in Section 1 concerning transportation workers was the issue. Lenz, a customer service representative, sued Yellow Transportation over alleged civil rights violations. The court concluded that Lenz was not a transportation worker. The court offered nonexclusive factors for making the decision.
