- Abstract
The COVID-19 pandemic has killed millions of people around the world and changed the lives of many more. It has affected the development of states, the new generation and of citizens. The world has been facing a different reality, as the pandemic is still in an active phase. Dealing with it requires high self-awareness and responsibility not only of states but also of citizens. As a result, the authorities had to declare a state of emergency and restrict human rights because of it. As state officials say, the restrictions stem from public need. For this purpose, the President is authorized by the Constitution to restrict the rights and freedoms guaranteed by the Constitution during a state of emergency or war. As some restrictions cause discomfort and irritation of society, it is important that countries try to restrict the fundamental rights to the lesser extent when fighting a pandemic. However, as the court said, at this point the most important thing is the life and health of the people.
