- Abstract
The article discusses a constitutional theory on the legitimacy of State powers and the limits of such power. It cites the September 11, 2001 terrorist attack as an example of a moral and juridical dilemma. It cites a decision by the German Federal Constitional Court which held that the statute allowing preventive shooting-down of hijacked airplanes violates the principle of respect for human dignity. It suggests that the pursuit by a democratic State of the public good should be consistent with providing due respect to the dignity of the person.
