- Abstract
This Comment explains some fundamentals of the military justice system, emphasizing the two focuses of the debate to change the Uniform Code of Military Justice (UCMJ). It traces the chronological development of the UCMJ regarding the two themes and discusses what debate is likely to occur in the future. It also reviews the military's sexual assault statistics, and, using the statistics, it treats the question of whether changes to the UCMJ have been or will be effective in combating the problem in the military and whether revisions to the UCMJ have changed the way the military prosecutes sexual assaults. This Comment argues that legislators should not alter the commander's role in the military justice system nor should they pass more legislation concerning the elements, factors or procedures regarding a sexual assault offense in the near future because these changes do not address the root of the sexual assault problem and current changes will undergo constitutional challenge.
