- Abstract
The article focuses on the possible expansion of the Americans with Disabilities Act (ADA) as it relates to local and state governments on facility accessibility. A background of the issues previously involving the ADA is presented. Federal law does not provide limitations period claims under Title II of the ADA or the Rehabilitation Act. Title II generally prohibits discrimination against qualified individuals with a disability in the provision of public services. ADA is a government anti-discrimination statute designed to provide a clear and comprehensive national mandate for the elimination of discrimination against individuals with disabilities. Litigation issues concerning the ADA are discussed. Cities are committed to conform with the ADA, the Rehabilitation Act and its regulations.
