- Abstract
The article discusses the two key challenges in the negotiations on environmental goods including the dual and multiple use of environmental products and a review process of product coverage. The intrinsic nature of multiple uses of environmental goods imposes an additional compliance on customs authorities as it requires post-clearance audits. Identifying environmental goods based on their end use at customs would appear to be inevitable if countries wish to screen out products that are not used for environmental purposes. Once established, countries could set an artificial threshold and allow special customs clearance procedures for products that are predominantly used for environmental purposes.
