- Abstract
The article reports on a court ruling stating that it is not allowed to offer an online platform for pharmacies through which pharmacies can sell medication to patients if the platform operator charges fees to the pharmacies. The court ruling pertains to the case of a Dutch company that was warned by the Chamber of Pharmacists. The counterclaim is admissible and justified since the court has international jurisdiction and the counterclaim is privileged. The plaintiff violates the Pharmacy Act by mediating prescriptions to pharmacies and charging a monthly basic fee for it. The article also discusses the legal provisions for pharmacies and their business models to ensure the economic independence of pharmacists. It also addresses the question of whether moor baths, moor packs, and moor kneading can be classified as medical devices.
