The author discusses the scope of the state detention authority under the laws of war. He presents information on the enemy status and their relation with law of neutrality and non-international armed conflict. He examines the counterterrorism using municipal neutrality statutes for the interpretation of international law and relative effect of United Nations (UN) on the law of neutrality for violations of neutral duties.
