The article discusses the reasons why the author believes that the background principles of law should be taken seriously in relation to the problems associated with sea-level rise, and it mentions the U.S. Supreme Court's ruling in the 1992 case Lucas v. South Carolina Coastal Council which deals with a per se taking by a government entity. U.S. government regulations and the economic value of property are examined, along with the legal rights of property owners in America.
